Attorney Jeremy Hogan responds to user questions about the XRP case. The employee asked if the SEC would ask for summary judgment to be reconsidered before appealing. Hogan said the committee could conduct a preliminary investigation.
He added that, however, he doubts that the SEC will file a complaint after his death. It seems very dangerous now. Hogan said that if the SEC loses on appeal, it will be the controlling authority in the case. This could cause the SEC to throw the case to the Second Circuit.
